Welcome and thank-you for your interest in consigning with TheStealVault.com! We want to make your consignment experience as simple as possible so we have provided this Consignment Terms of Service & Consignment Agreement that outlines our policies and procedures regarding our services, consignment terms, service fees, Make an Offer, and Layaway options as well as learning how to earn more as a consignor through selling with TheStealVault.com.
WHO ARE WE?
THESTEALVAULT.COM hereinafter (“TSV”) is an interactive online resale marketplace with a retail “Drop & Shop” location in Greenwich, Connecticut that accommodates all your online consignment needs so you don’t have to.
TSV starts working for you as soon as we receive your shipment of accepted designer items at our Drop & Shop location. First, we will inspect your items for any issues that might slow down your inventory from being prepared for photography. Next, we will steam, prepare, and post your items with in-depth product descriptions and measurements that will be priced competitively. While your items are posted and live for sale, TSV negotiates any offers through our interactive Make an Offer platform to sell your Real Life, Real Luxury items. You may also see your items posted on our social media platforms as well.

Email us at Consign@TheStealVault.com to request your inbound label. You will receive a welcome email outlining your next steps. Please read our Consignment Terms & Policy Agreement in its entirety to see important company policies and details surrounding our Rewards Program that allows you to earn a commission on all sales from everyone you refer to us!
THE PROCESS
The process of receiving boxes and creating an inventory of your items can take up to anywhere from 1-3 business days. Photographing them and listing them typically takes about 14-21 business days. If you do not see your items online within two weeks of receipt of your items you can email us at Consign@TheStealVault.com.
PRICING
Prices are determined by TSV, all item
discounts are on an automatic monthly percentage rate and at the sole
discretion of TSV. You as the consigner understand that the final sales price may
vary if a buyer makes an offer and it is accepted through any of our online sales
outlets such as TSV’s make an offer platform, Drop & Shop retail
store promotions, or through any of our sales outlets or our 3rd party selling
platforms.
MAKE AN OFFER OPTION
TSV has an interactive platform where buyers can Make an Offer on all our products or Layaway items online or at our “Drop & Shop” location in Greenwich , Connecticut. All offers made on our items are carefully considered and all reasonable offers will be accepted. TSV reserves the right to negotiate any offer(s) or decline any offer(s) made on any item regardless of starting price. Offers and negotiations are left at the sole discretion of TSV officers. TSV further reserves the right to automatically reduce the consigned item to promote a sale.
HOLDING A PRICE ON A PARTICULAR CONSIGNED ITEM
TSV can hold your item at a particular price through our internal coding call “HP” meaning “Hold Price”. TSV is aware and can appreciate the true value of an item and will respect your desire to temporally hold it at a particular price for a limited time. After 60 days, however it will return to the automated discounted price, once your item has reached the 60-day timeframe on HP status, it will automatically revert to the discounted rate. Buyers will still have the ability to make an offer on the item even though the HP status is applied and all reasonable offers will be considered however the item will not be discounted during the HP status.
CONSIGNING & RECLAIMING ITEMS WITH US
TSV’s consignment policy is to sell your item until it is sold, however if there is an item(s) that you would like to reclaim after 8 months you can request to have your item(s) shipped back to you 2 weeks before your 8-month expiration date. You can find your 2 week reclaim period date written on your consignment agreement. You will be responsible for all shipping and box fees associated with the return of your reclaimed items, all fees must be paid before any shipment can leave our facility. Email us within 2 weeks of your ReturnToMe@TheStealVault.com. If you do not request your items within these two weeks, you will not be able to request any of your items and TSV will continue to sell them until your inventory is sold. YOU WILL NOT HAVE THE OPTION TO REQUEST YOUR ITEMS TO BE RETURNED TO YOU ONCE YOUR 2 WEEK RECLAIM DATE EXPIRES. THERE WILL BE NO EXCEPTIONS. To request your item(s) to be returned to you, you must email us at: returntome@thestealvault.com two weeks before your reclaim period expires. TSV does not call, email or notify you; it is up to you to contact us.
LEGAL
TSV agrees to take reasonable care and precaution of consigned items. However, you, the consigner, agree that TSV shall not be responsible for loss or damage due to fire, theft, or any other cause whatsoever and shall not in any event be liable for any amount or for any reason. TSV does not additionally insure your items. Consignor will either maintain insurance or be self-insured in the event of loss or damage.
VIEWING YOUR ITEMS
You are able to view your items on line by entering your Account Number into the search bar on our homepage, or in the search bar on any page of TheStealVault.com. You can find your account number on the top right corner of your consignment agreement. To view your items online with us simply type your account number in all caps including the dash. It takes approximately 12-21 days weeks to start to see your inventory online.
HOW TO GET STARTED / STEP 1
To get started with consigning with TheStealVault.com, contact us at Consign@TheStealVault.com and request your inbound shipping label and box (if needed) and we will send you your welcome email with your consignment agreement that you will need to sign and email back to us or mail back to us with your shipment. WHAT YOU DO NEXT / STEP 2
Put your Item(s) in our box/your box and ship it to us using the inbound label. We will sort and inspect your approved designer item(s) once we receive your shipment. We recommend and encourage that you include several items in each box. A list of TSV’s approved consignor items, are specified at here in our Approved Designer Requirements and Restrictions Tab.
WHAT WE DO NEXT
If your RealLife RealLuxury Designer items
meet all of our criteria within TheStealVault’s Designer Requirements and Restrictions, we will inspect, prepare and take photos of your item(s), tag
and inventory your item(s), create a description for your inventory then
determine the sale price before posting it for sale on TheStealVault.com. TheStealVault.com
does not provide pricing before we post your items for sale, you can view your priced
inventory on TheStealVault.com by entering your account number as it reads on
your consignment agreement. We may also sell your item through any of our selling
platforms including but not limited to: our Make an Offer platform, our Layaway
option, and through our Drop & Shop location located in Greenwich, Connecticut. We may, at
our discretion, post your Items for sale on other third-party auction and sales
websites or sell your item through some other channel in addition to selling it
through TSV and once your item sells, we will ship it to the buyer.
WHERE WE STORE YOUR CONSIGNED ITEMS
We store our consigners items in our storage
facility located in Greenwich, Connecticut. When you send an item to us, you are sending
it directly to our Drop & Shop location in Greenwich, Connecticut, not a
remote location. TheStealVault.com also has a warehouse in Alabama where we
ship out a portion of our handbags from.
SHIPPING
As a service to our clients, we provide complimentary UPS pre-paid shipping Labels for your shipment(s).
Here are some important tips to help you through the process:
SHIPPING, REJECTED ITEMS AND OUR ACCOUNTABILITY
We reserve the right to charge to you a
surcharge if your box is oversized. The information about the largest accepted
box can be found at TheStealVault.com/shippingfees.
We may accept or reject your Item at our sole
discretion. Reasons for rejection may include, without limitation, if the Item
is ripped, dirty, stained, has strong odor, is with moth holes, is not of a designer
category we support, (please see our accepted designer list).
Any Item sent to our storage facility is
stored at your sole risk and responsibility. TSV agrees to take reasonable care
and precaution of consigned items however by signing a consignment agreement
with us you agree that TSV shall not be responsible for loss or damage due to
fire, theft, or any other cause whatsoever and shall not in any event be liable
for any amount or for any reason including but not limited to acts or
omissions, negligent, deliberate, or otherwise, of us or persons under our
control or caused by acts of third parties, by any forces of nature, or
otherwise. In addition, TSV does not additionally insure your items. You, the consignor
will either maintain insurance at your own expense or be self-insured in the
event of loss or damage.
WHAT NOT TO SHIP
Please do not ship any item that does not
qualify as an accepted designer item. Click here to see a list of Approved and Accepted Designer Brands. Further, you may not send any item to our storage
facility which (1) could damage our storage facility (2) could be in any way
dangerous to people or property in or around our storage facility, or during
the delivery to or from our storage facility, or (3) does not conform with the
Item Requirements and Restrictions guidelines below or our instructions as
provided to you from time to time.
RECLAIMING YOUR ITEMS
You will have a two-week window to reclaim your
unsold item(s). To reclaim any unsold Item(s) you must contact us within two
weeks before your 8-month reclaim date written on your contract and only if it
has not already been sold. We must receive
you reclaim email within your 2-week timeframe by emailing us at ReturnToMe@TheStealVault.com. We will gladly return the item(s)
you request and ship them back to you at the address you provided with your
account information. You agree to pay any and all fees outstanding on your
account plus any service fees and return fees associated with reclaiming your items.

for the return of the Item(s).
YOU AGREE...
You represent and warrant that when we sell your item(s)
and or post your Item(s) to our website:
YOU FURTHER AGREE…
You agree not to send us prohibited items.
The Prohibited Item list is available at thestealvault.com/prohibiteditems.
We reserve the right to immediately dispose of Prohibited Items and to suspend
or terminate your consignment agreement and your account if you send us a
Prohibited Item. You understand and agree that you will still be liable for any
and all unpaid fees even if your account is suspended or terminated.
REJECTED ITEMS
We will notify you if we reject an item via
the e-mail address associated with your account (the “Rejection Notification”).
We agree to store your Item for 14 days following the Rejection Notification. If
you want us to send your rejected item back, you must order and pay for the
box, shipping and all fees associated with sending us a rejected item. Our

IF YOU
DO NOT RECLAIM YOUR ITEM WITHIN THIS 14-DAY PERIOD, WE WILL TAKE POSSESSION OF
THE ITEM AND WE WILL, WITHOUT FURTHER NOTICE AND IN OUR SOLE DISCRETION, HAVE
THE FULL AUTHORITY TO USE, SELL, DONATE TO CHARITY, OR OTHERWISE DISPOSE OF
SUCH ITEM WITHOUT ANY FURTHER OBLIGATION, PAYMENT, OR OTHERWISE TO YOU.
We reserve the right to charge a surcharge to
you if too many Items in one box are rejected. We also reserve the right to
suspend your account for a certain period or terminate it based on excessive
amount of rejects.
AUTHENTICATION
TheStealVault.com only sells 100% authentic designer items. We have
professional authenticators in house to authenticate your items. Should we need
further authentication from a third party to help with authenticating an item and
it is deemed inauthentic or the authenticity cannot be conclusively determined,
you will be charged a $25 fee (per inauthentic item) on the next scheduled
invoice to cover the additional authentication expense we incurred. Should
there be items we are unable to sell due to authenticity issues, return
shipping is at your expense ($25 per box). If you do not wish to have items
returned to you, we will gladly donate them on your behalf.
DESIGNER REPAIRS
In order to assist in maximizing the value of
your consigned items, we may repair any item(s) of your inventory that is in
need of repair. If you ship an item to TSV that we deem valuable but that is in
need of any such repair, cleaning or any issue whatsoever that we feel that can
be easily rectified by our repair specialist, we will automatically and without
permission or notice to you assess a fee to clean, repair, or prepare an item for
sale. If you do not agree to the terms of our repair policy, your only recourse
is to terminate your agreement with us as this service is provided at the sole
discretion of TheStealVault.com. See our

PRICING
TSV determines the listing sales price for
your Item(s). All pricing is determined by TSV and at our discretion based on
similar items that have sold at TheStealVault.com. Other factors that may affect
the product pricing is the condition of the item, the season, and the item’s
potential value as determined by us. TSV may also adjust the price of the item(s)
at any time and shall consider all viable offers that we may consider feasible.

WHAT ARE YOUR EARNINGS
As of February 1, 2019: For any items consigned to
TheStealVault.com: You, the consignor, will receive 60% of the selling price for
items that sell for $999 and below, 75% for items that sell between $1,000 and
$4,999 and 80% for items that sell for $5,000 and above. TSV does not assess
any listing fees, however it is important you view a list of our service fees, ie. cleaning, box fees etc., that could impact your account. Any fees
associated with your account will not affect the percentage earned but will be
deducted at payout. To see a list of fees that might be applied to your account
please thestealvault.com/consignmentfees. TSV reserves the right to adjust consignor
earnings at the sole and absolute discretion of TheStealVault.com.
HOW TO EARN MORE WITH OUR REWARDS PROGRAM
For all new consignors you send to us you
will receive a $25.00 credit to your account that can be used towards future
purchases with TheStealVault.com or you may receive your $25.00 Bonus Rewards
money in a form of payment. For all buyers and consignors you send to us you will receive a 20%
commission of TSV’s portion of any sale made with your Rewards Code. Your Rewards
earnings get applied to your payout account and will be paid during the following
payment cycle. To learn how to get

THESTEALVAULT.COM SALES FEES
After an item has sold and we have received
payment from the buyer, we will pay to you a portion of the sales proceeds
after we have deducted the Inbound service fee, box (if applicable), and any
outstanding fees and surcharges including fees and surcharges from prior
inbound submissions that you owe to us here. You can view a list of our Fees and
how they are calculated here: thestealvault.com/consignmentfees.
If there are sales proceeds of $10 or more
after we have deducted TheStealVault.com Fees, we will credit your account with
the sales proceeds or otherwise mail you a check. We will make the payout by
the end of the following calendar month following the month in which we receive
the payment, typically 30-45 days.
You must provide us with valid and accurate
Payment Address or other requested payment information in order for us to payout
or mail payments to you. We reserve the right, upon notice to you, to correct
any sales proceeds errors, even if a sale proceed has already been mailed or transferred
to you. We also reserve the right to withhold any or all sales proceeds if we
have reason to believe you have breached this Agreement.
WE FURTHER RESERVE THE RIGHT
We may change our fees and policies,
including adjusting the TheStealVault.com fees and imposing new and additional fees,
at any time and in our sole discretion. Your sole recourse if you do not accept
a fees policies changes is to terminate your use of our agreement.
You are solely responsible for paying all
applicable taxes and other governmental charges and fees, if any associated
with selling with TheStealVault.com.
AMENDMENTS
TheStealVault.com reserves the right in its sole and absolute discretion
to modify the terms of this Agreement from time to time. TheStealVault.com will
use commercially reasonable efforts to notify you if the terms of this
Agreement have changed. All items received after the date of such modification
will be subject to the new terms. If you do not agree to any revised terms,
your sole recourse is to terminate this Agreement. To the extent that you do
not terminate this Agreement following a modification of the terms by TheStealVault.com, you will be deemed to have accepted all such modifications to this
Agreement.
DONATIONS
TSV reserves the right to change and update our
charitable affiliations at any time and at our discretion. A list of our charitable
organizations can be viewed here at: thestealvault.com/charity. If you
choose this option, you authorize us to donate any unsold items when we deem appropriate.
You understand and agree that the charity may pay us a commission for the
donations that are made through TSV.
THESTEALVAULT
MAKES NO WARRANTY THAT THESTEALVAULT.COM’S SERVICES WILL BE UNINTERRUPTED,
TIMELY, SECURE, OR ERROR-FREE.
THESTEALVAULT AND ITS
SUBSIDIARIES, AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, PARTNERS, AND LICENSORS
SHALL NOT BE LIABLE TO YOU FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL,
CONSEQUENTIAL, OR EXEMPLARY DAMAGES OR FOR DAMAGES FOR LOSS OF PROFITS,
GOODWILL, USE, DATA, OR FOR OTHER INTANGIBLE LOSSES (EVEN IF THESTEALVAULT HAS
BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES) RESULTING FROM: (A) THE USE OR
THE INABILITY TO USE THESTEALVAULT’S SERVICES OR THESTEALVALUT’S WEBSITE; (B)
UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR DATA; (C) THE
ACTIVITIES CONTEMPLATED BY THIS AGREEMENT; OR (D) ANY OTHER MATTER RELATING TO THESTEALVAULT’S
SERVICES OR THIS AGREEMENT. IN NO EVENT WILL THESTEALVALUT’S LIABILITY UNDER
THIS AGREEMENT EXCEED THE AMOUNT IT HAS ACTUALLY RECEIVED AS A RESULT OF
SELLING YOUR PROPERTY HEREUNDER. THE FOREGOING DISCLAIMERS AND LIMITATIONS ARE
A FUNDAMENTAL PART OF THE BASIS OF THESTEALVAULT’S BUSINESS, AND THESTEALVAULT
WOULD NOT ENTER INTO THIS AGREEMENT WITHOUT SUCH DISCLAIMERS AND LIMITATIONS.
LEGAL
This agreement shall be construed and
governed by the laws of the State of Connecticut. Furthermore, you and TheStealVault.com
hereby agree to arbitration pursuant to the jurisdiction of the courts of Fairfield County, Connecticut.
